If you are caught with any amount of marijuana lawyers in Puerto Rico, you will be charged with a felony offense. This offense may require up to three years in jail and a maximum fine of $5,000. If this is your first drug offense, you may be able to undergo probation instead of jail. If this is an option, the charge will be dropped from your record upon successful completion of the probationary period.
Puerto Rico Marijuana Laws and Penalties
Being caught with any amount of marijuana for a subsequent time, is also a felony charge. This charge may require up to six years of prison time and a maximum fine of $5,000. Unlike first time offenders, those in this category are unable to forego probation or drug rehab treatment instead of jail time. The final jail sentence is determined by the judge based on the amount of marijuana in your possession as well as where the marijuana was found (such as near drug-free zones or in school zones, etc.).
Marijuana Cultivation or Sale:
If you are caught selling or growing any amount of marijuana in Puerto Rico, it is a felony offense. This offense carries a penalty of up to 12 years in prison and a maximum fine of $20,000. Unlike possession, a sale, delivery or manufacturer charge cannot be carried out through a probation sentence.
If you are caught selling, growing or delivering any amount of marijuana crimes to a minor or within 1,000 feet of a recreation facility or school you will be charged with a felony offense. This offense requires all penalties to be doubled than they would if the person was caught outside of these specified zones.
